These terms cover design services sold by Groundwork Design Co., a design studio of Muthler Landscaping & Construction LLC ("we," "us"), 913 Bellefonte Avenue, Lock Haven, PA 17745. By checking the box to accept them, or by paying for a design package, you agree to them. They cover design services only; any construction is a separate written contract. Contractors who order through our contractor portal are covered by our Contractor Terms instead.

1. What you're buying

• A landscape and hardscape design for one property, delivered as PDF files, as described for your package on our Online Landscape Design page.
• Turnaround times are business days (Monday–Friday, excluding U.S. federal holidays). They start when we confirm we have your complete photos, measurements and site information, not on the day you pay.
• Rush delivery, extra revision rounds and other add-ons are included only if you paid for them.

2. Your information

• We design from the photos, measurements, surveys and descriptions you send, and you're responsible for their accuracy. If the site turns out to be different (a wrong measurement, or a slope, utility, easement or setback you didn't mention), changes needed to fix the plan may count as an extra revision.
• You confirm you own the property or have the owner's permission to have it designed.

3. Revisions

• Your package includes a set number of revision rounds: Single Space 1, Full Yard 2, Build-Ready 3. A round is one list of changes, sent together.
• Extra rounds are $150 each. Adding a new area or switching to a different project is a package upgrade, not a revision.
• Ask for revisions within 60 days of your first draft. If we don't hear from you for 60 days after a draft, that draft becomes your final plan.

4. What our plans are, and what they aren't

• We are the design studio of a design-build contractor. We are not licensed architects, landscape architects, professional engineers or land surveyors, and we don't provide architecture, landscape architecture, engineering or surveying services. Our plans are design drawings: not sealed, stamped or engineered drawings, not a survey, and not a permit set. We prepare them from what you send us, without a site visit.
• Build-Ready is the name of our most detailed package. A Build-Ready plan has more construction detail, but it is still a design drawing set, not an engineered plan or a permit set.
• Retaining walls over 4 feet; walls holding up a driveway, parking area, structure or other load; and structural, stormwater or grading work that affects neighbors or needs a permit may require a design by a licensed professional in your state. When we see these items, we flag them on the plan. Flagging them does not make us responsible for the engineering, and not every item that needs an engineer will be flagged.
• Grading and drainage shown on a plan are design concepts, not an engineered drainage or stormwater design.
• You and your installer are responsible for permits, local codes, HOA approvals, property lines, setbacks, easements, soil and drainage conditions, frost depth and utility locates. Call 811 before anyone digs.
• Deck, porch and pavilion framing sheets are a starting point for your builder and building department, drawn from standard span practice. They are not engineered, and your building department may require its own details or an engineer, especially for tall decks, roof loads or hot tubs.
• Quantities and material lists are estimates for planning and bidding. Your installer is responsible for final quantities, means and methods, and the quality of construction.
• Plants are matched to the USDA hardiness zone for your ZIP code. Availability, growth and survival depend on local conditions and care.
• Don't present our plans as the work of a licensed architect, landscape architect, engineer or surveyor, and don't remove the notes on the drawings.

5. Price, payment and refunds

• Packages are paid in full at checkout through Stripe, in U.S. dollars. Any sales tax that applies is added at checkout.
• Full refund any time before we start your first draft. Once drafting starts, the fee is non-refundable, and we keep revising within your package until the plan works for you.
• If we can't complete your design, for example because the site information can't be completed, we refund the part of the work we didn't deliver.

6. Founding-client pricing

• The first 10 design orders placed with the founding offer get 40% off the package price. Add-ons are full price.
• In return, you agree to send us honest feedback about the service within 30 days of your final plan, which we may quote on our website with a note that you received founding pricing, and to let us show your design without your name or address. What you say is up to you; the discount doesn't depend on it.
• One founding order per household. It can't be combined with other offers.

7. Build credit in central Pennsylvania

• If Muthler Landscaping & Construction builds your design under a signed home improvement contract within 12 months of your final plan, the design fee you paid comes off the build price.
• The credit has no cash value and can't be transferred.

8. Who owns the plan

• You get a license to use your plan at your property: build it, get bids, and share it with contractors, your HOA and your town. You may not sell the plan or use it for another property.
• We keep the copyright and may show the design in our portfolio and marketing without your name or address.
• The sample plans on our website are for illustration only and may not be used for construction.

9. Warranty and limits of our liability

• We prepare every design with reasonable care. Other than that promise, designs are provided "as is." To the fullest extent the law allows, we disclaim all other warranties, express or implied, including fitness for a particular purpose and any warranty that a design meets the codes, permit rules or site conditions where it is built.
• Our total liability for any claim related to a design is limited to the amount you paid for that design. We are not liable for construction work done by others, for site conditions we weren't told about, or for indirect or consequential damages.
• You agree to hold us harmless from claims by your contractor, neighbors, HOA or anyone else that come from building the design, except to the extent a claim is caused by our own negligence.
• Nothing in these terms limits any right you have under law that can't be waived.

10. Governing law and electronic acceptance

Pennsylvania law governs these terms. Disputes will be handled in the courts of Clinton County, Pennsylvania, unless the law of your state requires otherwise.

Your electronic acceptance, by checking a box or paying online, is your signature under Pennsylvania's Electronic Transactions Act and the federal E-SIGN Act, and these terms are as binding as a signed paper agreement.
